南宋刘后村书判中的法律理念探讨
摘 要
作为理学家的刘后村，他的思想渊源众多，不仅吸取了儒家孔孟思想的精华，而且也融合了道
家、法家等诸多学派的思想学说，更是继承了理学大家朱熹的思想。在他为政为官的数十年
中，刘后村积极参与法律实践，他的法律思想以书判的形式幸存后世。
书判是中国古代裁决狱讼的法律文书，本文以《名公书判清明集》和《后村先生大全集》中收
集的刘后村生平所作的判文为研究对象，探讨书判中所反映的南宋时期刘后村法律思想。
绪论部分主要回顾了宋代士大夫、理学家、书判研究及刘后村思想研究四方面的学术史及研究
现状；接下来第二章则考察刘后村生平、法律实践和书判着述；第三章论述了刘后村的天理伦
理法律观，从家庭血缘伦理和义理决狱两方面探讨刘后村的理学法律思想；第四章论述了刘后
村的司法审判中士大夫的自觉精神、法与情理一体、注重客观理性、以民为本和严刑恤刑思
想；第五章以刘后村在审判中所体现的息讼思想为研究对像，分别论述了他的教化思想、调解
思想、生养思想及惩戒思想三方面，从中可以看出宋理学家法律思想在司法实践中的具体展
现；最后结语部分对全文进行简要总结，并再次论述后村书判中法律思想及后村的理学思想。

ABSTRACT
After principle scientist's Liu the village, his thought origin is multitudinous, notonly has absorbed the
Confucianist Confucianism thought essence, moreover alsofused Taoism, the legalist school and so on
many school of thought thought theories,has inherited Neo-Confucianism everybody Zhu Xi's thought.
In him for the politicsfor in official's dozens of years, Liu Houcun participates in the legal
practicepositively, his legal thought the form survivance later generation which sentences bythe book.
Judgements was legal instruments of ancient china, the book《The Justieial Casesjudged by the
famous law 一 officer of song dynasty》and 《A collection ofMr.honcun》‘s Judgements research
object all Liu Hou -cun's life, discuss the Liu Hou-cun's Thoughts of Law inSongDynasty.
Introduction Mainly reviewed the Song Dynasty literary intelligentsia, theprinciple scientist, the book
has sentenced the research and Liu Houcun the thoughtstudies four aspects the histories of learning
and the research present situation.
Meets down the second rules to inspect Liu Houcun the biography, the legal practiceand the book
sentences the writings. Third chapter elaborated the Liu Houcun naturaljustice ethics law view, decide
a lawsuit two aspects from the family bloodrelationship ethics and righteousness principle to discuss
Liu Houcun Neo-Confucianism law thought. Fourth chapter elaborated the aware mental, the law and
areason body, the attention objective rationality, which in the Liu Houcun judicial trialthe literary
intelligentsia is concerned about country and people pities the punishmentthought take the people as
this and the severe punishment. Fifth chapter drops alawsuit the thought take Liu Houcun which
manifests in the trial as the object of study,elaborated his enlightened thought, the mediation thought
separately, has given birthto the thought and the disciplinary punishment thought three aspects, may
see theSong Neo-Confucianism family discipline law thought in the judicial practiceconcrete
development. Finally the conclusion part carries on the brief summary to thefull text, after and
elaborates the village book to sentence the legal thought and thelatter village Neo-Confucianism
thought once more.
