基于民法的近代分家习惯演变探究
分家是传统中国社会一个关于家产传递方式的重要习惯，在历史的不断发展变化过程中已经形
成了一套相对明确而具体的规则体系。在清末变法修律之前，一直得到过国家法的承认。自近
代以来，中国大规模的移植西方法，使得传统的分家习惯受到了移植自西方的继承法的冲击，
最终随着 1930 年《中华民国民法典》的颁布而在国家法层面上永远的退出了历史舞台。但
是，分家习惯作为一种根植于中国民间数千年的习惯并没有消失，仍然广泛存在于现实生活，
尤其是中国的广大农村中。
本文拟在对中国历史上的分家习惯进行梳理的基础上，探讨近代民事立法中的分家习惯发展演
变过程，并分析中国近代由传统向现代转变的过程中分家习惯和国家法之间的关系。全文共分
为五个部分。导论主要介绍了问题的由来、目前学界关于分家问题的研究现状以及分家与继承
两组概念的界定。第二部分主要梳理了中国历史上的分家习惯，为下文的论述做准备。第三部
分主要对中国近代民事立法中关于分家习惯的规定进行疏理，以探究近代不同时期国家法对于
分家习惯的态度。第四部分主要分析了中国近代由传统向现代转变的过程中分家习惯与国家法
之间的关系。最后结语部分主要总结全文，对于分家这一习惯与国家法之间的冲突，国家法应
当充分尊重中国民间长期形成的习惯法，吸收分家习惯中合理的方面，不断完善继承法的内
容，在妥善处理两者间之间冲突的基础上取其精华，去其糟粕，使两者之间能做到较好的衔
接。

Abstract
Family division is an important custom about the pass to patrimony in the traditionalChinese society.
The process about family division has formed a relatively clear andspecific rule system in the evolving
history. Before the late Qing Dynasty amending law, ithad been acknowledged over the national law.
Since the modern China transplanted thewestern law on a large scale, the custom of the traditional
family division has conflictedwith the western inheritance law. With the promulgation of “Republic of
China Civil Code”in 1930, the custom of the family division has been abolished at the national law
level.
However, the custom of the family division, which has rooted in the thousands of years inChinese folk
custom, did not disappeared. Actually, it still widely exists in real life,especially in the vast rural areas
of China.
Based on the family division custom in the history, this paper aims to discuss themodern civil
legislation for the custom of the family division. And analyzing therelationship between the family
division custom and the national law in the process oftransforming the tradition to the modern time.
The paper is divided into five parts.
Introduction describes the origin of the problem, the academic research on the status of thefamily
division problem and the definition of the family division and inheritance. Thesecond part reviews the
family division custom in Chinese history that is preparing for thediscussion below. The third part
mainly discusses the provision of the modern Chinesecivil legislation about the family division, then
to explore the attitude to the national law ofthe family division custom at different period. The fourth
part analyzes the relationshipbetween the family division custom and the national law in the process of
thetransformation from the tradition to the modern. The last conclusion summarizes all thepaper. With
the conflict between the family division custom and the state law, the state lawshould fully respect the
customary law that has formed in Chinese folk for a long time,absorb the reasonable factors and
consummate the content of the inheritance law. So thatcan be done much better between the two.
