法律视角下宋代房屋租赁制度探讨
摘要
在社会经济快速发展、社会分工进一步细化、城市化进程加快的中国当下，多种因素的交织带
来了房屋租赁业的快速发展。房屋租赁作为一种非常有效的资源配置方式，在社会上发挥者重
要的调控功能，意义重大。其实中国的房屋租赁现象不仅可以追溯至远古的奴隶社会，而且从
那时起一直是在不间断地发展着并延续至今。而宋朝作为商业经济比较发达的朝代，商业的繁
荣和城市的发展、国家政策变化的影响及人们观念的转变，带来了宋代房屋租赁业的发展，是
房屋租赁业发展的一个典型时期。所以，本文的研究就着眼于宋代。
本文结合中国法律史学科的学科特点，采用法学和史学相结合的方法进行。

之前关于宋代房屋租赁的相关课题研究，无论是学术论文还是期刊论文，多出自历史院系专
家、学者之手，从法律角度来研究这一课题的尚比较少。所以，本文在吸收历史院系专家、学
者的研究成果同时，对上面所述的四部分从法律角度进行了研究。特别是针对对宋代房屋租赁
评价中的消极部分，结合现实情况，从有益于当今房屋租赁发展的角度出发，提出了相关的建
议，这也是本文的创新点所在。

Abstract
In the rapid development of society and economy, the social division of labor furtherrefinement, to
speed up the process of urbanization in China today, many interwoven factorsbrought about by the
rapid development of housing rental industry. Rental housing as a veryeffective allocation of
resources, play an important regulatory function in society, significance. Infact, the rental housing
phenomenon in China not only can be traced back to the ancient slavesociety, and since then has been
in the uninterrupted development and continue up to now. And theSong Dynasty as the commercial
economy is relatively developed, affect the transformationof development, commercial prosperity and
the city's national policy changes and the concept ofpeople, bring about the development of the Song
Dynasty housing rental industry, is atypical period for the development of housing rental industry.
Therefore, this study will focus onthe song dynasty.
In this paper, combined with the subject characteristics subject China legal history, lawand history of
using the method of combination of. To reflect the contents of the article, forthe performance of the

Song Dynasty developed reason and historical evaluation” the content of the three part and

The related research on rental housing before Song Dynasty, whether academic papers orjournals,
from history department experts, scholars, to study this topic from a legal point ofview is less.
Therefore, this article in the absorption history research department experts,scholars at the same time,
the above four parts from the angle of law are studied. Especially for thesixth part of the negative part
of the rental housing in the evaluation of the SongDynasty, combined with the reality, starting from the
benefit of today's rental housingdevelopment point of view, put forward relevant proposals, which is
the innovation of this thesis.
